محكمة الاحتلال تواصل النظر في الالتماسات المقدمة ضد نتنياهو
تواصل محكمة الاحتلال العليا، اليوم الاثنين، النظر في الالتماسات المقدمة من عدة جهات ضد منع بنيامين نتنياهو زعيم حزب “الليكود” من تشكيل الحكومة الجديدة في ظل الاتهامات الموجهة له بقضايا الفساد، وكذلك في اتفاقه مع بيني غانتس زعيم حزب “أزرق – أبيض”، لتشكيل حكومة وحدة.
وأنهت لجنة قضائية مكونة من 11 قاضيًا، مساء أمس، جلسة استمرت 7 ساعات نظرت خلالها في بعض الالتماسات المقدمة بشأن منع نتنياهو من تشكيل الحكومة.
وستستأنف الجلسة التي تبث عبر الهواء مباشرة، اليوم، للنظر في الاتفاق بين نتنياهو وغانتس الذي وقع نهاية الشهر الماضي. بحسب قناة 12 العبرية.
وستصدر المحكمة قرارها في نهاية مداولات قضائية ستجريها في وقت لاحق من الأسبوع الجاري.
وبينما ترجح مصادر إسرائيلية أن لا تعارض المحكمة أن يشكل نتنياهو الحكومة، إلا أنها تؤكد بأن المحكمة قد تلغي بعض شروط الاتفاق الائتلافي بين “الليكود” و”أزرق – أبيض”، ما يؤدي لخلافات جديدة بشأن تشكيل الحكومة بين الحزبين، ويتسبب بإمكانية فشل تشكيلها وعودة الأمور إلى ما كانت عليه من خلافات قبل. بحسب القناة العبرية.
وفي حال فشل تشكيل الحكومة حتى منتصف ليلة الأربعاء – الخميس المقبل، وهو الموعد النهائي المحدد قانونيًا للكنيست لترشيح شخصية لتشكيل الحكومة، فإن ذلك يعني حل الكنيست والتوجه لانتخابات رابعة، وهو ما تخشاه الكثير من الأحزاب وخاصةً “أزرق – أبيض” بعد تفككه عقب تحالف غانتس مع نتنياهو، وانفصال يائير لابيد وموشيه يعلون.
وبحسب قناة ريشت كان، فإن نتنياهو خلال جلسة مغلقة أمس شن هجومًا حادًا على المحكمة العليا التي اتهمها بأنها تستطيع اتخاذ أي قرار بدون إمكانية منعها من ذلك.
ووفقًا للقناة، فإن هناك مخاوف حقيقية لدى حزب “أزرق – أبيض” من إلغاء المحكمة لبعض بنود الاتفاق مع الليكود.
فيما حذر وزراء وأعضاء في الكنيست عن الليكود من جر “إسرائيل” لانتخابات رابعة في حال ألغت المحكمة بنود مهمة من الاتفاق.
وكان المستشار القضائي للحكومة الإسرائيلية أفيحاي ماندلبليت، أبلغ يوم الخمس الماضي، المحكمة العليا أنه لا يوجد عائق قانوني يمنع نتنياهو من تشكيل الحكومة رغم لوائح الاتهام الموجهة ضده.
وبين ماندلبليت بشأن الاتفاق الائتلافي، أنه يمكن النظر في هذا الاتفاق في حال تم تفعيله ولا داعي لذلك حاليًا على الرغم من وجود بعض البنود التي تتعارض مع القوانين الأساسية المعمول بها.
فيما أبلغ مقر رئيس الكيان الإسرائيلي رؤوفين ريفلين، المحكمة العليا في لائحة جوابية، بأن مسألة تولي نتنياهو للحكومة المقبلة ليست من صلاحية ريفلين بعد أن نقل الأمر برمته للكنيست لاختيار شخصية لتولي الحكومة
